These Terms of Service ("Terms") govern your access to and use of the products, services, and website provided by Mize ("we," "us," or "our"), including CloudPulse, Hatch, RoleRadar, and the mize.pro website (collectively, the "Services").
By purchasing, creating an account, or using any of our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
You must be at least 18 years old to use our Services. By using our Services, you represent that you meet this age requirement.
Upon purchase, Mize grants you a perpetual, non-exclusive, non-transferable license to use, modify, and deploy the Hatch source code for your own products and applications.
You may not resell, sublicense, or distribute the Hatch source code or any derivative boilerplate, template, or starter-kit products. You may not share repository access with individuals who have not purchased a license.
You own the code you build on top of Hatch. Mize retains ownership of the Hatch framework, including all original source code, architecture, and documentation.
The $249 tier includes 12 months of repository updates from the date of purchase. After expiration, you retain the code as-is but receive no further updates. The $149 tier does not include updates.
Hatch is delivered via private GitHub repository access. You must maintain a GitHub account. Due to the nature of digital source code products, all sales are final. Refunds may be issued at Mize's sole discretion.
Mize is not responsible for how you configure, deploy, or secure your Hatch-based applications. You are solely responsible for the security and operation of your deployed products.
CloudPulse connects to your Kubernetes clusters via kubeconfig credentials you provide. You are responsible for ensuring the credentials have appropriate permission scopes.
CloudPulse provides automated scaling recommendations and, when enabled, can execute scaling actions on your clusters. You acknowledge that automated orchestration carries inherent risk. You must review and approve scaling policies before enabling live mode. Mize disclaims liability for consequences of automated scaling decisions, including but not limited to service degradation, outages, or data loss.
CloudPulse subscriptions are billed monthly. You may cancel at any time. No refunds are provided for partial months. Free tier accounts have no uptime guarantee.
Cluster data is retained for 30 days after account cancellation, then permanently deleted. You may request earlier deletion by contacting us.
You retain ownership of all resume content you upload. Mize processes your resume solely to provide job matching and analysis services. We do not sell, share, or use your resume data for any other purpose.
RoleRadar accesses publicly available career pages on your behalf. We do not guarantee the accuracy, completeness, or timeliness of job listings. Listings may change or be removed by the employer at any time.
RoleRadar is a discovery and matching tool. It is not an employment agency, recruiter, or job placement service. We make no guarantees regarding employment outcomes.
Job match scores and rankings are algorithmic estimates based on your resume and job descriptions. You should not rely solely on these scores for career decisions.
Free tier accounts are limited to 3 tracked companies with manual scanning only. Pro subscriptions may be cancelled at any time. Annual plans are non-refundable after 30 days from purchase.
You agree not to:
Mize retains all rights, title, and interest in and to our Services, including all source code, algorithms, designs, documentation, trademarks, and other intellectual property, except as explicitly granted in these Terms (such as the Hatch license in Section 4).
You retain ownership of the Content you provide through our Services. By submitting Content, you grant Mize a limited license to process that Content solely as necessary to provide the Services.
To the maximum extent permitted by applicable law, Mize's total liability for any claims arising from or related to these Terms or your use of the Services is limited to the amount you paid to Mize in the 12 months preceding the claim.
In no event shall Mize be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, whether based on warranty, contract, tort, or any other legal theory, even if Mize has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Mize and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MIZE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
Either party may terminate these Terms at any time. You may terminate by discontinuing use of our Services and, for subscription products, cancelling your subscription.
Mize may suspend or terminate your access immediately if you violate these Terms. We will make reasonable efforts to notify you, except where prohibited by law or where immediate action is necessary to prevent harm.
Upon termination, provisions that by their nature should survive will continue in effect, including Sections 8, 10, 11, 12, and 14.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA) Commercial Arbitration Rules. The arbitration shall take place in California.
Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of any class, consolidated, or representative action.
Small claims exception: Either party may bring qualifying claims in small claims court.
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by posting the updated Terms on our website and updating the effective date. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of those changes.
